Mrs. Renee repeatedly failed to make herself available, citing a series of personal and non-urgent matters, including being in the middle of straightening her hair, attending a lacrosse game, and other unspecified commitments. She further postponed engagement to a later week, claiming she was too busy. This ongoing pattern of shifting explanations and lack of availability reflected a clear absence of professionalism and materially interfered with the transaction timeline. This was a cash purchase that should have proceeded efficiently. The inspection identified multiple significant defects, including compromised water lines, a cracked furnace requiring replacement, and serious safety concerns with the rear deck. Additional issues included mold in the bathroom ceiling, as well as necessary repairs to both the roof and chimney, with the chimney presenting an imminent structural hazard. Despite these findings, the seller refused to address the furnace defect and instead attempted to impose an alternative solution that was neither requested nor acceptable. Notably, we did not request financial concessions or remediation for several other substantial defects—including the deck, mold, roof, or chimney—in a good-faith effort to facilitate closing. We acted diligently and in good faith throughout the process. However, the seller’s continued refusal to cooperate or engage reasonably resulted in the failure of the transaction, without any clear or justifiable basis.
